Lee Marcus has been practicing law in Florida since 1992 and has been a certified mediator since 2008. His background includes representation of businesses, insurers and individuals (plaintiff and defense) in a broad range of legal matters, with a focus on first-party and third-party insurance coverage litigation, ERISA benefits litigation, insurer bad-faith litigation, contract negotiation and litigation, civil rights litigation, and appellate practice. He has also represented numerous businesses as their counsel for employment law matters, general business concerns, contract negotiations, and contract dispute resolution and litigation. Mr. Marcus taught Employment Law courses as an adjunct professor in the Human Resource Management Masters program at Webster University and has lectured throughout the country on the topics of ERISA Benefits litigation, Insurer Bad Faith, Insurance Coverage, and Mediation. He is also certified by the Florida Department of Financial Services as a continuing education instructor for Life Insurance and Health Insurance, and has conducted in-house continuing education programs for numerous insurers throughout the country on Ethical Claims Adjustment and Investigation. As such, he has a unique understanding of insurance coverage, insurer bad faith law and ERISA benefits law that allows him to mediate cases in those areas of practice with efficiency and insight.
Mr. Marcus holds an AV® Preeminent rating from Martindale-Hubbell. He received his B.S. in English and Business Administration, cum laude, from the State University of New York at Albany, and his J.D. from the University of Florida. He is a former Senior Executive Editor of the Florida Law Review, and served as a teaching fellow for Legal Research and Writing at the University of Florida College of Law.
Mr. Marcus is admitted to practice in all state and federal courts in Florida, the Eleventh Circuit Court of Appeals, and the Supreme Court of the United States. He appeared before the Supreme Court on a civil rights matter in 2015, and he has impacted change in ERISA law within the Eleventh Circuit.
Outside his professional life, Mr. Marcus is a member and the Presiding Justice for the Benevolent and Protective Order of Elks, Lodge 2165. He has served as a judge and jury advisor for the Orange County Teen Court program since 2010, and has served on the boards for Windermere Little League, Anthony House for the Homeless, and the Roper YMCA Guides program. Mr. Marcus has coached youth baseball and basketball since his teens, and is certified by NFHS as a baseball umpire and by USA Synchro (nka USA Artistic Swimming) as a synchronized swim judge (F1). He is an avid fan of baseball and enjoys salt-water fishing and lobster diving.
